Legal Question in Criminal Law in Massachusetts

give a prescription drug to a friend

My nice gave one of her prescription pills Etherol(HADD medicine)to a friend who is in the military to help him study for a test he was taken the next day. The next day he was chosen for a random drug test and it showed in the urine as he had taken a very high doses of enphitamine. He has never taken drugs before. He is now being prosecuted and the military want to cort marshal him unless he gives the name of the person who gave him the drug.I know that the military don't have jurestiction over a civilian, but they will probably give the name to the local authorities.

My question is, what kind of consequences can my nice get into if he give the name and the miliyary reports it to the local police.

Re: give a prescription drug to a friend

The chance of civilian authorities prosecuting your niece, based on the facts you posted, are minimal. The problems with prosecuting a case based on your facts are the lack of evidence, and the scenario is a typical he said, she said without additional evidence.
