Legal Question in Civil Rights Law in Massachusetts
Question On Ombudsman Immunity From Giving Testimony
I am Pro Se in a civil suit against a University and met with their Ombudsman to resolve discrimination matters there, he has testimony which will prove that action by the University and now when asked for affidavit on such makes claims of independance and immunity. His Office had a disclaimer hung on the doorway upon entering which stated that only the President of the University can give and allow the Ombudsman to participate and give testimony in any civil suit, for which I have made a request to the President for, and have yet to receive. How does one get the Ombudsman to give an affidavit of his knowledge on matters that where directed to him by the plaintiff? He has stated his willingness to do so, but states his independance of his office for not being able to. I am in Massachusetts and it concerns a University here and myself in a race discrimination case now before the courts. The testimony sought is extremely important since it proves the acts of discrimination forthright!
Thakyou.

If you have filed a court action you can subpoena the ombudsman for a deposition. You will bear the expense of a stenographer. If the ombudsman is a "mediator" and you wnet to her to mediate your dispute, she may not be required to attend deposition or testify in court.
