Legal Question in Disability Law in Massachusetts
What is a common argument against granting declaratory judgment? Particularly, if a party is seeking a declaratory judgment without any injunctive relief in a claim under, say, the ADA, what might a party argue?

An action for Declaratory Judgment is a request that the court declare the rights of the parties. Your defenses will be specific to the facts of your case, and focused on arguing that the party is not entitled to the declaration sought. There are also numerous procedural and substantive defenses available to any given party.
