Legal Question in Disability Law in Massachusetts

# of employees for employer coverage under Mass. ADA

I need to know whether my employer is covered under Massachusetts employment disability discrimination law. There are 7 employees total. I know the federal ADA has a 25 employee threshold and some states have lower thresholds. What is it in Mass.? Thank you!

Any employer with more than 5 employees is subject to MA discrimination law, Chapter 151B

The Massachusetts employment discrimination

statute, M.G.L. c 151B, applies to private and

public employers with 6 or more employees.

You should be aware that, like most claims under

the state discrimination statute, you must file a

complaint with the Massachusetts Commission

Against Discrimination usually within six months

from the date of the discriminatory action.
