My advice would be to sit down with an experienced estate planner, and discuss the possibility of naming another individual as executor of your estate. There is some risk that if you name one of the three brothers, they will fight amongst themselves and maybe even waste valuable assets. You can also make sure that you use a no-contest clause.

Whatever you decide to do, you should use the services of a professional, and make sure that your will is absolutely sound, and that it effectively does what you want it to do. Please feel free to contact us at 617-357-4898 if you would like to discuss your wishes with an experienced estate planning attorney.
