Legal Question in Disability Law in Massachusetts

Passed Over.

Recently I was passed up for a promotion, by someone who does not have any of my qualifications. The reason given to me was that my past negative attitude and also that my notes needed more detail.

I have been at the company for four years, six months later my new boss started. This person and i have never gotten along. She uses the word negative very freely, so since she and i have never seen eye to eye, negative has stayed with me. I have had many arguments with her, she consistently puts me down, yells at me in front of others, and plays favorites.

I took my problems to a higher level, but i did not do a great job defending myself, it was three against one. My point is the person given the job is here friend, they have a lot more in common. social/race issues. This person that got the position does not have a degree, good attendence, does not hand in note on time, and there are many other things that would not be professional to mention. Also she was told about this position a year ago, i was told a month ago. She has been taught things that i have not, whic h i was not aware of until recently.

The antidiscrimination laws address

discrimination because of a person's

gender, race, ethnicity, religion, age,

and gender preference, . . .

You give none of this information. You

mentioned only "social/race issues." Who

is the minority? You or your boss's friend?

There is no law against nepotism or against

hiring friends. . . . BUT if you are one of the "protected classes" and

your qualifications are provably better than

your boss's friend, then you have a shot at a

case.
