Legal Question in Appeals and Writs in Massachusetts

Recovering Attorney Fees

I was recently involved in a civil case. The case was dismissed, this is the notice of docket entry I received.

Judgement on motion to dismiss (pursuant to mass r civ p 12(b)(6) The action is dismissed abd that the defts recover costs entered on the docket pursuant to Mass R Civ P 58(a) and notice sent to parties pursuant to Mass R Civ P 77(d).

Does this mean I can recover my attorney fees, and if so how do I go about it. I tried to contact the clerk but the answering machine always picks up and there is no available space for a message.

I would apprecitate any assistance and advice.

Thank you

Re: Recovering Attorney Fees

"Costs" are not the same thing as attorney fees, but instead have a special meaning. There may be a basis for getting attorney fees, but I would have to know more about your case. Email me if you'd like. David Baker
