Legal Question in Banking Law in Massachusetts
We recently started an education fund 8 months ago after my first aunt passed away leaving her 3 children behind (10,14 & 17) Because my aunt passed away, the kids now need to live with their once absentee, gambling ex-husband. The donations were made after her death in lieu of flowers and is to be used to further their education when they become of age. Now, the father is trying to get the money from us and is threatening to call everyone that donated and tell them that it is being used fraudulently, even though it is in the bank collecting interest in its own account, waiting for them to graduate. Does he have any power here? How should be proceed? He is also threatening to stop them from seeing us.

If people donated money to an education fund for the benefit of the three minor children, I don't see how the father could possibly get the money. As for visitation, if he is the sole parent, I don't see any reason why he couldn't stop distant family members from visiting. However, if he truly is a gambler and is such a jerk, I would consult with a family law attorney to weigh all your options.
