should i file for bankrupsey?i am two mnths late for morgage payments i can not catch up i can not refience because i owe more then what its worth the bank is threatening fore closer i have a child i am scared and dont know what to do.

Are you working? Do you want to keep the house? There are still a lot of questions that are unanswered, but it appears that you maybe be a candidate for a Chapter 7 or Chapter 11

Bankruptcy is one of several options you may have. Filing does, indeed, grant you a short breathing period, but only a short one.

Other options include:

1) Contacting your lender and asking them to assist you handle the arrear payments;

2) Having a knowlegeable lawyer assist you in a "work-out" of your loan;

3) Selling the property quickly (at an auction - speak with a real estate auctioneer or through a real estate broker;

Even in bankruptcy (probably a last option), you might still be allowed to sell it (in a "short sale, perhaps), but you will need expert assistance.
