Bnkruptcy options

I'm in trouble with the IRS. I have a tax attorney negotiating a settlemnt now.

I have paid nothing on my credit card balances (all in my name only) but have kept them apprised of my ongoing tax problem.

They have all now gone to collections (lawyers and agencies)and they are unwilling to wait for IRS resolution before working out a payment plan.

I have no assets (home etc) except for an old car, some tools and furnitire.

Rather than deal with all the judgments that I am being threatened with I am considering bankruptcy.

Do you have a better solution.

If not and I have to file what happens to my wife. She has no assets either and has her own unsecured debt that she is staying current with.

Does she need to be part of the filing?

Your situation is really too complex to answer without actually sitting down and look at things. Generally speaking, bankruptcy does not solve tax problems. It can solve OTHER problems, making the tax problems bearable. It can also give you time to pay the taxes. As to your wife, she does not necessarily have to be a part of the filing, however if she is ALSO liable on any of the debts, it is to her advantage to file with you.
