Can I claim debts that I have already been brought to court over but am still unable to pay?

Yes, if you file for Bankruptcy you will be entiteld to a discharge of your debts. It does not matter whether creditors have judgments against you or not.
Some debts such as students loans, most taxes, child support, criminal restitution orders, debts for personal injury caused by a drunk driver, and the like
may not be able to be discharged in Bankruptcy.
You should consult with a lawyer as to which debts are able to be discharged.
In general, debts that are secured by property such as mortgage debts or car loans
would have to be paid if you wish to keep your property ( or you could pay up to the value of the
secured property and discharge the rest of the debt).
Otherwise the property will be taken and you will be discharged.
