Legal Question in Bankruptcy in Massachusetts

After discharge - What next?

My wife and I received our discharge from chapter 7 on December 28th. Our lawyer said that we cannot apply for another loan (auto) until we receive our settlement paper(s), however, dealerships are saying that we don't need this document, just proof of the discharge. I don't know what to do.

I'm reluctant to disagree with your attorney, who has a better handle on your case than I do, but in my professional experience proof of your discharge should suffice in applying for an auto loan.

Maybe you should contact your attorney's office and tell them what you're hearing from the auto dealership, get some clarification, or better still put the auto dealership in touch with your attorney's office and let them work out the particulars.

What does your lawyer mean by "settlement papers"? That is not a term I associate with bankruptcy. That question aside, I would recommend you trust your lawyer. The dealerships want to make a sale and don't really care about the details of these things. Go over everything with your lawyer and don't hesitate to ask questions, and keep asking them until you undestand the answer. Good luck!

I can only surmise that your attorney is referring to your actual Chapter 7 discharge. In my opinion, the status of your discharge in bankruptcy can be readily ascertained. Unless there is some special requirement that you have the actual piece of paper, it should not be necessary to produce it.
