Legal Question in Bankruptcy in Massachusetts

Exemption/judgmdents

I have a judgment against me from a creditor. I do not work or own a home. However I do own a car, but it is my only means of transportation. Can I file an exemption from keeping my car?

Re: Exemption/judgmdents

The next step is the creditor will be looking to collect the money. This can be done by attaching assets such as a bank account or real estate or through garnishment of wages. This is usually not done right away usually you go through the supplementary process. Either you agree to begin paying or a judge determines how much you can afford to pay or you file Bankruptcy and if it your run of the mill unsecured debt then upon discharge the lawsuit along with the debt is discharged. In terms of exemptions, since you have no real estate you would use the federal exemptions and if you are a typical Debtor then the exemptions should cover it. You can check to see what you car is worth just google kelly blue book. Any other questions drop me an email.
