Legal Question in Bankruptcy in Massachusetts
I filed Bankruptcy 6 months ago. The Town filed a proof of claim alleging that I owed $18k in real estate taxes. When I went to have my plan confirmed by the Courts the Town filed a motion asking for my case to be dismissed. The Court dismissed my case and now the Town is alleging that I owed 115k. This is outrageous because it has only been 6 months and how can the cost balloon up that much. I called the Town and they say that the reason it ballooned up is because I am responsible for the legal fees incurred by the Town. Is this true. I think the reason they wanted to have my case dismissed is because they wanted to add additional money onto the claim. I need help.

The increase is startling, for sure. However, I suspect they are adding interest, too. By law, they are entitled to 16% interest. I am surprised that the court dismissed the case. Did you have a lawyer helping you? What did the lawyer say about why the case was dismissed? If you didn't have a lawyer, talk to one. You might be able to file a new case and get another chance.
