Legal Question in Bankruptcy in Massachusetts

Paying bills before filing

My bills are all paid to date but I can no longer continue to pay. I must declare Chap. 7. Should I just stop paying all bills even the ones that I will retain after bankruptcy like auto paymment?

Re: Paying bills before filing

Your question is difficult to answer in a posting like this because there are so many variables. In general, you have to include all debts in your bankruptcy, and whether you want to retain your automobile and make payments depends on an assessment of the vehicle, the debt on the vehicle, the interests of the debtor, the income of the debtor, etc. In general, a person contemplating bankruptcy will be advised to stop paying all bills except necessary household expenses (such as food and utilities) along with rent, mortgage and car payments, and the like. Whether you should stop paying and what bills you should stop paying is best answered by a lawyer who has heard all of the facts of your situation.
