Legal Question in Bankruptcy in Massachusetts

behind on payments

I am a little short on money this month. I filed for Ch. 13 this past July. I was behind on my mortage payments so they are included in the plan. I missed a few weeks of work and am coming up a little short of cash for my bills this month. I don't know whether I should pay my mortage payment a few weeks late or send my ch. 13 payment to the trustee a little late. How long is it before either one of them will contact me? I will be able to get caught up by the following month. Who should I be the most concerned with paying first? Thanks.

Re: behind on payments

Generally, the chapter 13 trustee will give you two or three months of arrears before causing problems. The mortgage bank is generally less tolerant. You should double check this with your attorney, or if you don't have one, call me to discuss. 617-367-4260
