Legal Question in Bankruptcy in Massachusetts

Re-Payment

Hi, I filed for bankruptcy and had it discharged 7 yrs ago. It was all credit cards about 40k Chase, NFCU,GMAC,etc. Before I filed my credit was perfect and since it has been perfect. My credit scores are all above 700 now. Here's my question: My concscience has been bothering me and I would like to know if the credit card companies would allow me to pay the debts back. My financial situation is still difficult but I could probably pay back a little every month. Thank You Phil

Re: Re-Payment

The credit card companies would probably be delighted for you to pay them back. Nothing in the Bankruptcy Code would prevent you from paying them back if you want to. However, there is absolutely NO reason why your conscience should bother you. All of these companies do business knowing full well that some of their customers are going to file a bankruptcy case. So, they build extra into their profit-margins to make sure they don't lose any money. Furthermore, their profits are amazing; you need not shed any tears for them. Trust me: they aren't shedding any tears for you. Ultimately, bankruptcy has biblical roots; read Deuteronomy chapter 15. There is no reason at all for your conscience to bother you. I strongly urge you to put this behind you and move on with your life. Best wishes, David Baker

That is quite an unusual question. And quite admirable of you. I would imagine most of the companies have already "written off" the debts on their tax returns. I think most would probably decline your offer of repayment. But it certainly wouldn't hurt to call each one and ask.

If you are still in tight financial circmstances, I would not advise repaying anthing. If you feel compelled, then you could offer a percentage of the debt paid over time.
