Re: Undistributed Funds

Many things could happen to such funds depending on several factors, including when and the extent to which, if at all, the unpaid creditor has called attention to the problem.

You will need to determine under what chapter the case is proceeding. If under chapter 13 or chapter 11, you will need to determine whether the court has confirmed a plan. If so, the provisions for missed payments may be in the plan. If under chapter 13 and the confirmed plan does not provide for this event, then you may be able to find out more by contacting the chapter 13 trustee.

If the case is proceeding under a chapter 7, you will probably be best off contacting the chapter 7 trustee for more details.
