Will my credit be hurt if my spouse filed bankruptcy?

My spouse is going to file bankruptcy, is his filing going to influence my credit? I have bank accounts under my name and other properties. Will those be taken away by the court? If I want to apply for a student loan in the next year, is his filing going to jeopardize my application?

A firm answer to this question is difficult because the credit reporting agencies generally are not subject to the bankruptcy court's jurisdiction. Plus, they only report what the creditors tell them. So, if a creditor makes a report, whether correctly or by mistake, it get repeated by the credit reporting agencies. Can the error be corrected? Yes, but it takes time. The answer to your original question is that your spouse's filing should NOT affect your credit, but it is almost impossible to say for sure. Also, any property that you own, separate and apart from your spouse, is not likely to be affected by the bankruptcy. Best wishes.
