Legal Question in Business Law in Massachusetts
The BBB in MA lists our company as out of business, even though they know we are in business. We moved out of their jurisdiction 6 years ago. We are in business and have been continuously since 1999. We contacted them last year from Tucson AZ and asked them to update our page. They agreed to put a link to the Tucson listing for NEIH which appears at the bottom of the page. I am certain that their false listing is costing us money and I want it removed from their website. How do I go about that ?

Send them a certified letter informing them you are in business in AZ and ask them to remove the misleading information from their web site. Give them two weeks to complete the work. If you want you can indicate the false statement is a violation of MGL c 93A, deceptive business practice and as such you require they comply.
Otherwise retain an attorney to write a letter on your behalf. If they do not comply your only other alternative is to file a lawsuit.
