Can you use the same business name of a business that already exhist's if you spell it different?

The short answer is maybe. If the name is such that your business and its name would be confused with each other, you may get a cease and desist letter and if you do not comply with the demand, a lawsuit,

If the name is too close, you may not even be able to register it if you intend to incorporate it.
