Business Lease?

I rent a garage from my fathers business...If I sign a 99-year lease with him am I protected from his soon to be ex-wife getting the whole building and I am out of a job and my business?

While a lease affords both parties certain protections, it depends upon how the lease is dratfted and structured for the purpose of affording either the lessor or the lessee maximum protection.;)) In sum, we lawyers don't have a crystal ball to predict the future, all we can do is anticipate the obstacles and utilize our knowledge of both the law and human behavior to protect our client's interests.

This is unlikely to achieve the results that you want, but you should discuss this with a lawyer in the family law arena. We business lawyers really aren't qualified to advise you on the powers of a family court judge in the context of your parents' divorce.

It certainly wouldn't hurt to get a lease, but you'd have to record a Notice of Lease with the Registry of Deeds per MGL c. 183 �4.
