Legal Question in Business Law in Massachusetts
I have been a business partners with my husband of twenty seven years. The business is an SCorp fence company. I'm listed as treasurer and he is president. We are coming into our busy season and for two years our marriage is over. I have approached him requesting a formal document from our attorney and I would hold off filing for divorce. He refuses and I am forced to cancel all my projects that are extremely beneficial to business. I plan on filing for divorce on Monday and wondering what my options are.
Thank you

If you have been active in the business and own shares in the company, you have the right to continue to operate as you have and your divorce attorney should know how to handle the issue.
If you do not own shares in the business, but have been active in the business you can claim an interest in the business as it continues to operate. If you wish to discuss this in more detail you can call me on Monday afternoon in my office.
As a Franchise Attorney I don't understand your statement "I am forced to cancel all my projects that are extremely beneficial to business." How is his not signing some kind of formal document a reason to hurt the business? You really need to consult with a good business and divorce attorney in your area for specific advice.
