Legal Question in Business Law in Massachusetts
if you buy into a franchise and they do not tell you that there are going to be major changes coming that you have to invest in as a new owner can you sue them for full disclosure?
1 Answer from Attorneys
I think the question is can you sue them for failing to make full disclosure of their intent to make significant changes at the time you invested.
The short answer is maybe. It will depend upon what the changes are and how soon after your initial investment they were made as well as a host of other factors.
While Massachusetts does not have a franchise law, if the franchisor is from out of state, then he should have filed the appropriate papers with the FTC for franchises.
I suggest you contact an attorney and take all of your franchise paperwork as well as any correspondence and have him'her review your options.
