Company Closing
My husband has worked for a large hotel chain for 24 yrs. 10 months and two days. Yesterday he was informed that the hotel is being bought by another company and that it will soon close for major renovation. With his current employer, he was entitled to a lifetime benefit upon reaching his 25 anniversary with the hotel. With the takeover, that benefit will be lost. What are his recourses? My husband is willing to relocate to another hotel within the chain but is doubtful that another hotel will accept him because of his age. Isn't his current employer obligated to give 60 day notice which would allow him his 25 years?

Retain an attorney to review your husband's employment contract as the current employer may be required to allow him to continue to work at another location to attain 25 years and may be prohibited from discriminating against him based on his age. Good Luck!

First, you need to know when the closing will take place and when your husband's last day of work will be for the company. Second, your husband should take his contract, employee handbook, employment contract if he has one to an employment specialist. You need to find out if your husband has any vaation time left and if that will be counted towards the 25 years.
If the company is laying him off, depending upon the size of the company, it may be required to give him some notice under federal law. If your husband is part of a union, it may also provide some assistance here.
