credit report

Back in 2002 I had promblems making my truck payments and the lein holder tried to repo my truck but could not locate it so the lein holder went to superior court and tried to sue me for the return of the truck once I was served I talked to there attorney and he said all the wanted was the truck and that would be the end of it.So I gave back the truck and the court case was dissmissed.Now for the past 5 years the lein holder is putting on my credit a negative charge off of $4300. According to the dissmissal of the court case the lein holder had 90 days to put any money that I owed and never did.So for the past 5 years I tried many times to get this off my credit report and the keep putting it on every time I request it off so it looks like a new negative report.My question is can I sue this major lein holder for continuing to keep this on my credit report.

It depends upon your contract, and what other steps the lender took or didn't take. As a preliminary step, you should request the paperwork from the lender that they claim justifies the charge off. (E.g., that you owe an additional amount after return of the vehicle.) With paperwork in hand, you could then speak with an attorney...
