Legal Question in Business Law in Massachusetts

Help me please

MY current web site host sent me the wrong login information for one of my web sites, and they acknowledged that they did in an email already, so when I logged in to the site I didn't reconigize the files that were there so I deleted them. Now the people who owns the web site are saying I hacked into their site and might of stole personal information from their customers which I didn't because I deleted the files and not saved them.

Now my host has shutdown my web site until this is straightened away.

The other people whos site I deleted by accident are saying I hacked into their site and are trying to prosicute me for it.

Can I get some help please.

First thing to do is take a deep breath.

If you used a password provided by your host to log into your website and your host directed you to someone else's website - this is not your problem - this is your host's problem. As long as you acted in good faith and did not intentionally access the other person's website, you are not responsible for the lost files.

Nevertheless, you have two issues to deal with:

1. Your host is interfering with your business operations.

2. Like it or not you need to help clean up your host's mess for your own sake and clearly explain your position to the host and the other party.

In other words you need to write a clear and concise letter to both parties. If you need some help with this or issues regarding your domain and host issues feel free to give me a call - 508 565 1413.

If the other party sues you (i.e. you are served a complaint) talk to an attorney immediately.

It's an interesting "comedy of errors," but seriously I'm sorry that your site has been shut down and that you're hearing from the other side.

Sometimes being represented by an attorney can empower you in a situation such as this. Even if it's only limited representation, maybe drafting a letter or two on your behalf and communicating with "the other side."

You have several options. One of them is to send them 93a letter of demand. You may well consider the costs of hiring an attorney vs. the costs of running a business, and being "prosecuted." I do not understand what prosecution means, whether it is criminal or civil, if it is criminal, you may need to consult a criminal defense attorney familiar with this type of action, of which I am not.
