Email been hack and used

Recently we found someone who used with our company title and run their own business, their email address are exactly the same with us and only upfront title address with themselves. Shall I assume them as hacker or any? possible to file lawsuit againts them?

It is unclear whether you have been hacked or your identity has been stolen. It is highly likely that you do have various causes of action against this person, depending upon what he has specifically done and my be able to do.

It is very difficult to determine from your brief facts what rights you may have from 93A actions for deceiptive business practices to Trademark infringement or perhaps even more wrongful actions.

Yes, you certainly can do something about this -- apparent violations of state unfair competition laws among other things. If interstate commerce is involved, there would be remedies under federal trademark laws as well.
