Legal Question in Business Law in Massachusetts
I currently hold a All Alcohol Beverage License in Massachusetts. The restaurant I was granted the license for has since closed. i would like to move the license, in my name, to a restaurant with my husband listed as the sole proprietor. Does this have to be done as a change of location and DBA, or as a total transfer of license, even though it is staying in my name?

You need to transfer the license to a new location and if your husband is going to operate under the license he will need to be at least partial owner or you need to be a partner in the restaurant.
I would call an attorney who handles liquor licenses regularly. I have a partner who does as part of his regular practice all the time, I do it on a more limited basis.

As a Franchise Attorney with some knowledge of liquor licenses, I can tell you this. Contact the agency that issued your liquor license. They will be able to answer most, if not all, of your questions and provide the necessary forms. After all, that's what your tax dollars pay for. If for some unlikely reason this doesn't work, consult with a good business or franchise attorney in your area for specific advice.
