Legal Question in Business Law in Massachusetts
How legal is a non-compete agreement in Massachusetts for a service company?

Non-competes are generally enforceable within certain limitations under Massachusetts law. However, they must be reasonable in scope and duration relative to the position. They also must be signed at the beginning of employment unless they are part of a promotion or there is real consideration provided -- keeping your job is not consideration.
To give you a better answer more information is required.
As a Franchise Attorney I must ask that you provide additional information. Is the non-compete for employees of an established company? Or is it in connection with the sale of a business to a third party? Consult with a good business or franchise attorney in your area for specific advice.
