Legal Question in Business Law in Massachusetts

Liability Concerns for Freelance Video Educators

I am in the process of creating a video education company that will travel to clients' homes and schools to teach kids how to use video cameras and editing software, as well as act in the movies. We are a team of artists doing this on our own. What sort of liability insurance and other legal precautions are we obligated to have and what is advisable? Where would we look for more information about laws for this type of situation?

With respect to insurance, I suggest you contact a business insurance agent. You would probably need workmens Comp, general liability and if appropriate an umbrella policy. You need to balance the insurance against cost and real potential for liability.

I think I would set-up a corporation or LLC to limit personal liabilty and have a set of agreements that the customer signs with regard to your coming to the home.

Please feel free to contact me if you have more questions. Good Luck.

I do not believe there is any particular insurance requirement. I would suggest you contact a capable insurance agent, describe the business you are intending to operate and seek guidance from him/her as to the necessary types of coverage.

With respect to the business itself, you should probably consider some form of written authorization permitting you to do that which you intend to do. Another consideration would be a document that hold you and/or your company harmless from any act or thing you may cause to occur on the customer's property. As for source material, the closing business to what you describe would, I believe, be videographers who do public events, weddings, bar mitzvahs and the like.
