Loss of Sales
I have a small business that I run with my family on Sundays. We have a pull along trailer that holds the goods that we offer for sale. Each Sunday we take the trailer to the site that we operate and conduct our business. Our trailer is parked at one of those 24 hour storage facilities. We have never had a problem accessing our trailer. However, this past Sunday 11/14/2004, we went to the storage facility and found someone else's truck blocking our hitch on our trailer. There was no way to hook up our truck to bring our trailer to our site that we conduct business. I feel that this is comparable to someone pulling their truck up to the doors of any business and blocking them, thus denying the business the ability to open. My question is, if I were to bring this to small claims court, would I be able to recover my lost sales? Also, who do I name as the defendant? The main company is in Indiana, I'm not sure if the person who has the truck here in Massachusetts is a franchise. So I'm not sure who to name. Thanks.

You have described nothing that could or should cause a legal action against the truck, its driver or its owner.
