Legal Question in Business Law in Massachusetts

loss of work

can you sue a business for loss of business? example: I design custom furniture and the company I use to build it made me lose a great deal of business because they messed up a kitchen for the customer who wanted more things made. The customer went to another designer for the products. Can I sue for the loss of thousands of dollars I would have made?

Re: loss of work

The short answer is maybe. It depends on your relationship with the other business contractually and your ability to prove that their errors caused the loss of work. Such litigation can be expensive.

There are facts that will need to be shown to get a recovery, first their work was substandard or not to design standard. You will have to show that they failed to fix things in a timely way.

However, if they acted responsibly and the only reason you lost business was that the client felt notwithstanding their honoring their obligation that they and you were too much of a hastle to work with, then you probably don't have much of a case.

Facts and contracts will dictate your ability to recover.
