Legal Question in Business Law in Massachusetts
Massachusetts Business Law
Can I provide a shopping service for folks in Massachusetts for any items requested and charge the cost of purchase price plus $20 delivery service fee per item?
If a client requests cigarettes to be purchased at a NH store and I add a $20 delivery fee is that legal?
Please inform. Does it matter where a personal shopper shops or can they shop anywhere?

Re: Massachusetts Business Law
Shipping certain items accross state lines without a license is illegal if done as part of a commercial enterprise. Those items include liquor and cigarettes. The reason is most states have a state tax on those items independent of sales tax.
As to a fee for being a personal shopper I am aware of no MA state regulations.
I think you will find that absent a very large item or set of items, that a charge of $20 per item would be deemed a little expensive unless this includes a delivery fee.
