Legal Question in Business Law in Massachusetts

I ordered 20 softball jerseys online through a company based out of Massachusetts and now I am getting the run around from the owner of the company. Only way of contact is e-mail and he has failed to give me a due date of my product. According to his website and his initial e-mails I would have these jerseys by May 1st. Well now he is stating he didnt promise anything and shirts are still not ready. What do I do now? These jerseys were over $700 and he withdrew the money from my account on march 21.

1 Answer from Attorneys

Send him an email cancelling the order and demanding the return of the funds. You can also send him a demand for return of your money under MGL c 93A. The attorney general's office of consumer affairs can give you a form to use.

If they do not return the funds within 30 days of receipt of the MGL c 93A letter, then you can hire an attorney or sue them in MA small claims court. The Website must provide an address or your bank should be able to trace where the funds were transferred and to whom.

Good Luck.
