Legal Question in Business Law in Massachusetts

payroll error

I work for a company that for the past year has been paying me the wrong salary. They just notified me about the error and wants me to repay this money. I was unaware of this error. Do I have to repay this money? I live in Georgia, but my home office is in Burlington,MA.

Re: payroll error

Generally, yes. Even though it was their mistake, you did not technically earn the money so it never became yours.

Re: payroll error

From a legal standpoint, if they can prove that they overpaid you, you will need to reimburse them. From a practical standpoint, if you want to keep working for them, you should consider working out a mutually agreeable settlement and get it in writing as to future payments so that this won't come up again.
