How do I remove an attachment on my house in Massachusetts? The standard is "a likelihood of success on the merits". The Plaintiff used a judgment from federal court in MA against one of my defunct corporations (which is currently on appeal in the Federal Court on Statute of FraudsGrounds) and convinced a Superior court judge in Massachusetts in a subsequent lawsuit for fraudulent conveyance that there was a "likelihood of success" that I had unlawfully conveyed assets from the defunct company to me personally or some other entity which is not true. The other entity was also a co-defendant with the defunct company and the transfer of assets occurred prior to the litigation.
