Legal Question in Business Law in Massachusetts
I would like to start a company in the USA. At the moment I have an F-1 visa which expires in two years time. What exactly do I need to be able to start a company? Which structure would you recommend for a small technological business, C corporation or LLC? How much money would it cost? If we started a LLC or C corporation in one state, would we be able to work nation-wide and world-wide?

If you wish to start a company anywhere within the United States you may do so. Most (if not all) states allow anyone of legal age to create a corporation or Llc. by merely completing the organization forms and paying the initial registration fee. Once the company has been issued a charter (evidence of proper formation), you will need to obtain a federal and state tax identification number. In addition, if you choose to form an entity in a state different from the one in which you reside, you will need to obtain a resident agent designated to accept the service of legal papers for the business in case it is ever sued as a defendant in the future.

It is not a problem to create a business in the United States whether you are a US citizen or not. You can create a corporation or an LLC if you are a person who is 18 years old or older. The type of organization you select will depend on more factors than you have listed in your email and would depend on how many partners you have, if you intend to return to your home country or wish to stay here. It will also depend on whether this company will be a subsidiary of a foreign corporation or if it will be owned by non-US citizens or persons who do not have a green card.
As to operating in other states, depending on the amount of contact you have with those states you may or may not be required to register your Corporation or LLC with that state.
