Starting a buisness

Do I need a licese to start up a modeling agency or a model promotions company?

If so, how do I go about getting one?

This activity does not appear to be specifically regulated under MA law. I daresay that, given this vacuum, courts would be inclined to enforce the general law of unfair and deceptive trade practices (Ch. 93A) if any such acts were alleged, but the only laws relating to booking agents are concerned with actors and theatrical performances.

I am aware from past experience that California regulates talent agents, and I believe that NY does also. Thus, if your bookings relate to non-MA activities, you would need to examine whether your business or a particular contract with a model would become subject to the laws of such states.

When starting a business it is always advisable and often required that you register your busines both with the Secretary of State and the Clerk of the City where you operate. Such registration will also provide an identity for potential client's who wish to verify your legal exhistance with the state or town where you operate. Relative to a modeling agency, where you will be dealing with frequent contractual matters and multiple third parties, it would be wise to cionsider incorporating. This will create both a buffer against personal liability and provide a certain amount of protection for your personal assets.
