Legal Question in Business Law in Massachusetts
I worked for a short time selling credit card processing equipment, but left because it was 100% commission and I really wasn't getting anywhere. I did make 4 sales; one of which I was paid for, and one which fell through (he changed his mind before everything was set up), but I never got paid on the 2 others! Initially the company told me it was because I hadn't returned my laptop, but I kept the tracking number and was able to prove they did. Since then, I have been calling and/or emailing every day but no one ever gets back to me. These commissions are each about $200 and I need that money! It's a company that brags they pay commissions on a daily basis, but this is now going on about a month? Do I have any recourse, or is that money I'll never see?

As a Franchise Attorney I advise the following. Contact your local Employment Development or Labor Department. After you file a report, they will investigate and take necessary action. Consult with a good business or franchise attorney in your area for specific advice.

You have a claim under several statutes in Massachusetts that provide for as much as treble damages and legal fees. I would contact the AG's office as well as DUA and file a complaint. They will investigate and if the employer does not pay you, the will either give you a right to sue letter or require they pay you.
Otherwise contact an attorney to assist you.
