In a written contract if one party agrees to "remain silent" regarding a term how is that indicated in the contract.

Depends. What is ment by remains silent? If the contract is missing certain information, you may not have a contract at all. Also, if it is missing other types of information, the courts will read in some gap fillers to make the contract complete. Feel free to contact me if you have any further questions.

As a Franchise Attorney I agree with the other attorney answer. A party can't "remain silent" on certain key terms, like payment, identity, etc. Repost your question with further information on the term that is being kept silent.
