Legal Question in Civil Rights Law in Massachusetts

Distributing Naked Pictures

My girlfriend of 8 months took several naked pitcures of me with my consent and for her eyes only. We have recently broken up and she is now threatening to mail the pictures to my boss to embarrass me at work. Mail them to family and friends.

Is this illegal and how can I protect myself to prevent her from doing it? If she does do I have any recourse.

Thanks, Jim

Re: Distributing Naked Pictures

There's nothing like naked pictures to bring out the regret in a relationship!

If you can't make nice with her long enough to get your photos back, then go down to the local court and ask for an injunction against her doing anything with those pictures other than returning them to you.

Explain her threats and that way, if she feels like doing it anyway, you'll have the power of the court behind you. You have an emergency, explain to the court, because once she does what she's threatened, you will suffer intentional harm, humiliation, distress and probable loss of your job as well as the esteem of your peers.

You might also ask for a restraining order to keep her away from you, if she's acting crazy. It won't keep her away from you, but it will give the police the right to arrest her if she does.

Although there may be issues as to who "owns" the pictures, you should consult with an attorney about bringing criminal and civil charges for extortion. The attorney might be able to get a restraining order barring her from using the pictures. You may also have a claim for invasion of privacy under MA law.
