refusal to give court documents to another lawyer
We retained a lawyer to read court documents for an appeals process we paid him in cash and received a receipt. We have tried to contact him on many occasions tom proceed with the appeal but he has refusedm to get back to me. We hae since paid another lawyer to proceed with the case.Our problem is that we have been trying to now get the court documents from the first lawyer and he seems to be refusing to send them to the second lawyer. A release form was signed by the inmate but forn the last three months the second lawyer has not yet received the case. Between myself and the second lawyers office we have called many many times with no success. My question is do we have any legal recourse against this lawyer who refuses to send the documents.

Certainly. Call your local bar association and ask them about their complaint procedure against a lawyer, get the forms, and follow through. Most lawyers will comply when they hear from disciplinary counsel. Good luck.

Immediately call the Massachusetts Board of Bar Overseers at 75 Federal Street, Boston, MA. If you miss the appeal deadline, you may have a case of malpractice against lawyer.
