Legal Question in Civil Rights Law in Massachusetts

small claims court application for out of state from present state!!

I am wondering can I file a complaint against someone in Keywest Florida who owes me $430.00.

Can I do this myself in the small claims court in Boston MA without having to go to Keywest myself, if so what forms do I use?

Can I make the person come here to Boston for such a small claim?

Can you tell me the best way without travel?

Hope to hear from you soon.

Hopefully,

Boston man

Re: small claims court application for out of state from present state!!

Unless you have a contract or other document that says you can bring the claim in Massachusetts, you are going to have bring the claim in Florida. You might be able to sue him in Massachusetts, and the person will likely not come to Massachusetts to defend it. However, you might find that you cannot enforce the default the judgment in Florida since some states will not allow default judgments to be enforced in their state. So - the short answer is - unless you want to go to Florida and do it yourself (or hire someone to do it), you might not be able to collect it.
