Legal Question in Civil Rights Law in Massachusetts

I have a step son partaally diabled who is in a state hospital for treatment and while under I.C.E. custody he had his Civil Rights and Human Rights violated fot about 2 years and before they let him out he contracted Hep. C Do i have a law suit.
