Legal Question in Constitutional Law in Massachusetts

Abuse of power, illegal tow.

Very abbreviated

My car was not at all connected to a tow truck. I said sorry but I would like to move the car myself, and that there was no reason to tow my car, for I was there to move it. I stepped into my car and tried to drive away but a women tow worker stepped behind the car so I couldnt move. I asked her to move out of my way but she refuse, all the while telling the second tow truck operator to hurry up and connect the vehicle.

The officer that had ticketed my car was present. I pleaded that there was no purpose to tow my car, that the ticket was punishment for the offence, and that towing was not, but only a means to remove a car from the spot. The officer replied that if I didnt step out of the car that I would be under arrest as he reached for his cuffs. (He never told me what for).

I said that this couldnt be legal that my car was being stolen from in front of me. The officer then threatened to arrest me again!! But what for??? I parked in a ''resident'' spot; I got a ticket, I wanted to move my car so that is did not get towed. Now Im subject to arrest? I believe my Civil liberties freedoms where threatened by the officer abusing his power and allowing my car to be towed without reason (stolen).

Depends on town or city.

Call internal police. Complain. Seek money back.
