Summons-Defendants rights?

Does the defendant in a case have the right to settle out of court once they receive a summons from the plantiff? In this instance the bank is suing the defendant for non-paying of a loan. Defendant wants to try to settle out of court.

You always have the ability to resolve the matter out of court. 95% of all cases filed are settled out of court, not tried to a jury.

I would suggest you call the attorney who filed suit and ask him or her if they are agreeable to an out of court resolution.
