Legal Question in Construction Law in Massachusetts

Bad Contractor

We hired a contractor to do work on

our house. Total cost would have

been 18K, we put 9k down for

building materials etc on 5/24/08

with plans to start the last week of

May. He finally showed 3 weeks later

after we place many calls with only

half the materials. He worked 1 full

day, then an hour or so the next day.

After the 1 day of work he asked for

the next 4500 that he is owed

claiming the roof was completed as

stated in the contract. We refused to

give it to him stating the roof was

not complete as ''roof'' also included

the roof of the farmers porch he was

to build but has not. He did provide

us with a contract, although only he

signed it we did not. We no longer

want him working on the house, as

we have discovered he is a history of

taking down payments and not

finishing the work but would like to

eventually get some of the 9k back

less any expenses including the 12

hours or so of work completed.
