Legal Question in Construction Law in Massachusetts

A plumber friend of my landlord put in a toilet at the house I rent. Long story short, our house was flooded creating alot of water damage and loss of personal things that were in the basement. Im also having to stay in a Motel and being incovenienced. Problem is landlord is telling insurance company that a pipe busted from toilet and never told them it was replaced day of flood. Basically he's covering for his friend and telling us we should of had renters insurance cause his insurance is only covering structural damage and nothing else. Do I have a case here? Should plumber pay for damages and loss of personal things?

I hope your landlord is paying for the motel...

By lying about the toilet, your landlord is basically committing insurance fraud. Maybe if you explained this point to your landlord, he would realize that, indeed, he has an obligation to pay for your things. I would say that, indeed, you have a case.

I agree with the previous attorney that you have a claim for damages based on your landlord's conduct. Attorneys will sometimes take cases like this on a contingency basis, meaning that you will only need to pay an attorney's fee if money is collected on your behalf. Good luck!
