Legal Question in Construction Law in Massachusetts

I had a walkway replaced and it was to pitch water to the street. The contractor pitched it the other way. He says that its already done and I havent paid him yet. The contract has no statements as to pitch, just dimensions. Any help?

This is a classic case where an apparently missing contract term, may have produced an unacceptable result. Although this response is limited by the meager factual background supplied, generally all constuction under contract on residential dwellings presuppose that the work will be done up to existing building codes of the area and done in a workmanlike manner. These standards need not be expressed specificly in the agreement covering the work to be done.

In this case, arguably the contractor is at fault. You may wish to explore your legal remedies further with a licensed attorney.
